By accessing or using any service provided by Master Technology ('Company', 'we', 'us', or 'our'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all clients, partners, and users of our technology solutions.

Our services are available to businesses and professionals only. By using our services, you represent that you are at least 18 years of age, have legal authority to enter into binding agreements on behalf of your organization, and will use services only for lawful business purposes.

4. Client Obligations

As a client of Master Technology, you agree to:

• Provide accurate and complete information required for service delivery.
• Comply with all applicable laws, including data protection laws (GDPR, KVKK).
• Comply with the terms and policies of third-party platforms used within our services (Google, Meta, TikTok, Snapchat, WhatsApp).
• Maintain the confidentiality of account credentials and API keys.
• Obtain necessary consents from end-users before processing their data through our systems.
• Promptly notify us of any security breaches or unauthorized access.

5. Prohibited Activities

You may not use our services to:

• Violate any applicable law, regulation, or third-party rights.
• Send spam or unsolicited messages without proper consent.
• Distribute malware, viruses, or any malicious software.
• Engage in fraudulent activities, phishing, or identity theft.
• Violate the platform policies of Google, Meta (Facebook/Instagram), TikTok, Snapchat, or WhatsApp.
• Infringe upon intellectual property rights of any party.
• Damage, disable, or impair our systems or networks.
• Attempt unauthorized access to our systems or client accounts.

6. Intellectual Property

All software, code, documentation, and materials developed by Master Technology remain our exclusive property or that of our licensors. You receive a limited, non-exclusive, non-transferable license to use our services as provided. Terms for custom developments are specified in individual service agreements.

7. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information exchanged during service delivery, including technical specifications, business processes, and client data. Confidentiality obligations survive termination of the service agreement for 3 years.

8. Payment Terms

Payment terms are specified in individual service agreements. Invoices are generally due within 15 days of issuance. Late payments may result in service suspension. All fees are exclusive of applicable taxes. We reserve the right to modify pricing with 30 days advance notice.

9. Disclaimer of Warranties

Our services are provided 'as is' and 'as available' without warranties of any kind. We do not warrant that services will be uninterrupted or error-free. We make no warranties regarding the results obtained from use of our services. This applies to the maximum extent permitted by applicable law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Master Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues. Our total liability for any claim shall not exceed the amount paid by you in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Master Technology and its officers, employees, and agents from any claims, liabilities, and expenses arising from your use of our services, violation of these terms, or violation of any third-party rights including platform policies of Google, Meta, TikTok, Snapchat, and WhatsApp.

12. Termination

Either party may terminate service agreements with 30 days written notice. We reserve the right to immediately suspend or terminate services if you violate these terms or applicable platform policies. Upon termination, we will handle your data in accordance with our Privacy Policy.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of Turkey. Disputes shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey. For EU clients, applicable EU consumer protection laws also apply.

14. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated with at least 30 days notice via email or platform notification. Continued use of our services after the effective date of changes constitutes acceptance of the updated terms.
